Terms of use

1. Purpose

These terms of use (the “Terms”) govern the use of the Colimo app (the “App”) and its in-app purchase, The Whole Garden. By downloading or using the App, you accept these Terms. They supplement Apple’s standard Licensed Application End User License Agreement, which also applies.

3. The App

Colimo helps families keep a calm table: placed in the middle of the table, the iPhone listens to the room’s sound level; while the table stays calm, Colimo the snail walks on and picks flowers, and when it’s too loud for too long, he hides in his shell and a soft reminder sounds. The App is available on iPhone (iOS 17 or later). Downloading is free and gives access, with no limit on time or number of sessions, to the vegetable patch garden, the “Wind chime” reminder, the three sensitivities, a summary after each session and the last three sessions of the history.

The App is used by children under the responsibility of an adult. Finishing a session, changing the settings, buying and opening an external link are protected by a question young children cannot answer. Purchases are made with the device’s Apple Account, under the responsibility of the adult who owns it.

4. An indicative level

The sound level computed by the App is indicative. An iPhone is not a sound level meter: the App is neither a certified measuring device nor a medical device, and makes no promise about hearing or health. The threshold is relative to the room’s background noise, heard at the start of each session. Colimo is a tool to help families; it does not replace adults’ attention or professional advice.

5. The Whole Garden purchase

• What it is: a single, non-consumable in-app purchase. It unlocks, with no time limit, two more gardens (the evening garden and the pond), three more reminder sounds, choosing the delay before the reminder and the full history. It is not a subscription: there is no trial, no renewal and nothing to cancel.
• Price: shown in the App and on the App Store before any purchase, including applicable taxes in your country. A reduced price may occasionally be offered, for example at launch.
• Sale and payment: the purchase is made with Apple, which sells it through the App Store, charges and invoices it under its own terms. It is charged once to your Apple Account when you confirm the purchase. Helby Studio never receives any payment data.
• Family Sharing: the purchase is shared with the members of your Family Sharing group (up to six people).
• Ask to Buy: if the purchase needs a parent’s approval, The Whole Garden opens as soon as Apple confirms the purchase.
• Restoring: the purchase can be restored at any time, on a new iPhone or after reinstalling, from the parents’ space (“Restore purchases”), with the same Apple Account.

6. Refunds

The purchase is made with Apple and subject to its terms. Refund requests are handled by Apple at reportaproblem.apple.com.

7. Intellectual property

The App, its name, its world (Colimo and his gardens), its texts, illustrations and sounds belong to Helby Studio and are protected by copyright. The illustrations were generated with artificial intelligence from Helby Studio’s art direction and prompts, then reworked by Helby Studio; the sounds are synthesized by Helby Studio. You are granted a personal, non-exclusive, non-commercial right to use the App. Copying or extracting its content is prohibited.

8. Availability and updates

We do our best to keep the App working well and we keep improving it. Some features may change; the content unlocked by the purchase remains available. The App works offline; a connection is only needed to purchase or restore it through the App Store.

9. Liability

Colimo is a table companion, not a monitoring tool. The reminder may not sound if the iPhone’s volume is too low, if the microphone is unavailable (during a call, for example) or if the session was finished. Helby Studio is not liable for misuse of the device, for interruptions caused by Apple or iOS, or for decisions based on a level that remains indicative.

10. Personal data

Colimo collects no data: sound is never recorded, stored or sent, and settings and history stay on the iPhone. See our privacy policy.

11. Changes to these Terms

We may update these Terms. The current version is always published on this page with its date, and significant changes will be announced in the App.

12. Governing law

These Terms are governed by French law, without prejudice to the mandatory consumer protection rules of your country of residence. If you have a problem with the App, please write to us first at colimo@helby.studio so we can find a solution together. For payment, billing or refund questions, please contact Apple (reportaproblem.apple.com), which sells the in-app purchase.
